Case of the petitioner is that he was
performing his duties in Daily “Nawa-e-Waqt” for last 24 years as Lead Maker against monthly
salary of Rs.5600/- in Grade-4. His salary was raised upto
Rs.11,500/- p.m., which was not commensurated
to the minimum wages fixed by Government of Pakistan. However, vide office
order dated 2nd August, 2016, the petitioner’s contract of service
was terminated with immediate effect and letter of termination shows that
lastly he was performing his duty as Junior Layout Designer (Contract). The
petitioner has also prayed for his reinstatement in the service.
Admittedly the publication “Nawa-e-Waqt” owns by Nida-e-Millat (Pvt.) Ltd., which
is a private limited company and not amenable to writ jurisdiction of this
court. However, if the petitioner is
aggrieved by termination of contract, remedy is available to invoke
jurisdiction of Labour Court and/or NIRC as the case
may be after complying with all requisite formalities. Learned counsel for the
petitioner, after arguing at some length, agrees to move to NIRC for
appropriate relief.
Petition
is dismissed alongwith pending applications. However, the petitioner may avail
appropriate remedy before competent forum in accordance with law.
