Muhammad Ali Mazhar, J: Both the
petitioners have approached to this court for directions against the respondent
No.2 and 3 to convene meeting of Selection Board as their last meeting was
convened in the year 2012. It is further prayed that meeting of Selection Board
ought to be conducted annually in terms of rules and regulations of Federal
Government. Directions have also been sought to convene meeting of Selection
Board to consider the petitioners for promotion to BS-20. Comments of the respondents are available on
record and their counsel pointed out Para-2 at Page-5 of their comments in
which it is stated as under:-
It was in this backdrop that no
meeting of the Selection Board could be held. It is respectfully submitted that
meeting of the Selection Board for considering promotion of the eligible BS-19
officers to the vacant posts of BS-20 under various Cadres (including promotion
cases of petitioners) was held on 30.01.2015, however, the Selection Board,
keeping in view the date of retirement of petitioner No.1 (Mr.Rehmatullah
Memon) w.e.f., 04.02.2015,
considered his case for promotion in BS-20 as a special case and recommended
him for promotion to the vacant post of
Director (M&E) BS-20. The cases of promotion of remaining officers against
eight (08) vacant posts under various cadres including case of petitioner No.2
(Mr.Muhammad Siddique) were
deferred till the de-notification of amend-

ments
in PQA Employees Service Regulations, 2011. The minutes of meeting of the
Selection Board have been forwarded to the Ministry of Ports & Shipping for
signature by the remaining members. Once
received back, the same shall be processed for approval by the Competent
Authority i.e., Federal Government in accordance with Regulation No.4 of PQA
Employees Service Regulations, 2011.
Learned counsel for the respondent
No.2 and 3 argued that case of the petitioner No.1 has already been considered
and recommended for proforma promotion in BS-20. So
far as case of the petitioner No.2 is concerned, his case has already been
considered by Selection Board and Minutes of Meeting have been sent for
approval to the Ministry of Port and Shipping. Since clear statement has been
made by learned counsel for the respondent No.2 and 3, this petition alongwith
pending applications is disposed of with the directions to Ministry of Port and
Shipping to expedite the process in relation to promotion of the petitioner
No.2 as recommended by Selection Board.
