Mr. Wali Muhammad Khoso, Advocate for petitioners.

Mr. Zulfiquar Ali Rajput, Standing Counsel.

Mrs. Shahida Ghani filed Vakalatnama for HESCO. The learned counsel for the petitioners submits that the petitioners are very poor persons and due to non-payment of bills, their electricity has been disconnected. He further argued that bills were issued for exaggerated amount which were beyond their consumption, despite that detection bills have been issued.

The learned counsel for HESCO argued that this petition is not maintainable as the petitioners have not invoked the jurisdiction of Electric Inspector. However, she submits that if the petitioners are agreed to approach the Electric Inspector and deposit 25% of the arrears, the electricity will be restored subject to final outcome of Electric Inspector’s decision. Counsel for the petitioners had agreed.

In view of above, this petition is disposed of alongwith pending application, with directions to the petitioners to deposit 25% of the arrears shown in their last bill including the payment of current bill. On deposit of this amount, the electricity connection will be restored by the HESCO as stated by their counsel. The petitioners will file appropriate application to the Electric Inspector for deciding the issue, if any including the detection bill. If any such application is filed, the Electric Inspector shall decide the same within three months. As soon as the arrears are deposited in terms of this order, the electricity connection will be restored immediately.
