The petitioner is also present along with her husband Muhammad Raheel.

Muhammad Yaseen respondent No.8 present in person.

Mr. Allah Bachayo Soomro, Addl. A.G. Sindh along with  SIP Manzoor Ali on behalf of SSP Hyderabad and ASI I/O Muhammad Jurial Chandio of Police Station Shahdadpur District Sanghar.

 

 

 

            Learned counsel for the petitioner argued that the petitioner has contracted marriage with Muhammad Raheel on 6.6.2016 by exercising her right of free will. Copies of Nikahnama and affidavit of free will are attached with the petition. The brother of the petitioner Abdul Rehman has lodged a false F.I.R. No.85 of 2016, at Police Station Shahdadpur District Sanghar under section 365-B, 34 PPC alleging abduction of the petitioner.

The petitioner present in person states that she has neither been abducted nor kidnapped and she is living with her husband Muhammad Raheel without any pressure or coercion therefore, the ASI of Police Station Shahdadpur was directed to record her statement wherein she has categorically stated that she has contracted marriage with Muhammad Raheel.

            The father of the petitioner Muhammad Yaseen has no objection.

The I/O undertakes to submit the report before the concerned Magistrate for cancellation of F.I.R. under ‘C’ class within two (02) days. Till such time the report is filed and order passed by the Magistrate no further arrest shall be made in the aforesaid crime.

            The ASI present is directed to provide protection to the petitioner and her husband so that they may reach to their abode.

            This petition stands disposed of in the above terms.
