Respondent No.3 Khadim Hussain present along with his wife Mst. Afroz Naz and Master Zakir Abbass.

            In compliance of the last order, respondent No.3 Khadim Hussain has produced Mst. Afroz Naz and Master Zakir Abbass aged about eight (08) months. The alleged detenue Mst. Afroz Naz though admits her marriage with Khadim Hussain but at present she states that due to misbehavior and maltreatment of the respondent No.3 and his family members and being sui juris she wants to join the company of her parents.

            The applicant Deedar Hussain is present along with his wife Ghulam Zahra. The alleged detenue Mst. Afroz Naz and her minor son Zakir Abbass are allowed to go with her parents. However, the respondent No.3 may file appropriate proceedings in the concerned Family Court if he wants restitution of conjugal rights or the custody of minor child in accordance with law.

So far as the issue of providing protection in Court is concerned, the D.P.G. undertakes to arrange police escort so that Mst. Afroz Naz and her parents may reach to their home safely.

            This criminal miscellaneous application stands disposed of.
