Applicant Ameer Bukhsh is present with his Counsel Mr. Nisar   Ahmed Durrani, Advocate, who has filed vakalatnama today in Court.

1&3.  Granted.

2&4.  Earlier in the same offence the bail application of the same applicant was filed in the Court of District and Sessions Judge, Shaheed Benazirabad in Crime No. 11/2016 P.S 60-Mile, district Shaheed Benazirabad. However, the Anticipatory Bail Application No.698/2016 was dismissed for non-prosecution on 28.05.2016. Precisely, the office has also raised the same objection here. After arguing at some length, learned Counsel for the applicant agrees that this pre-arrest bail application may be converted into protective bail application so that the applicant may be able to file proper pre-arrest bail application in the trial court. The Court noted that earlier also the same applicant was granted protective bail and orders are available but he failed to surrender before the trial Court for one or other reasons.

          Without touching the merits of the case, the applicant is granted protective bail for ten days as a last chance subject to his furnishing solvent surety in the sum of Rs.50,000/- with P.R Bond in the like amount to the satisfaction of Additional Registrar of this Court. This protective bail order will remain in force for ten days from today and will cease to exist after expiry of ten days or the date when the applicant will surrender before the trial court, whichever is earlier. No further protective bail will be granted to the applicant in this offence.

          The learned Counsel for the applicant requests for proper protection and shown some apprehension, therefore, concerned SSP will ensure that proper protection will be provided to the applicant so that he may not become the victim of any harassment or victimization at the time of surrendering before trial court.

The bail application is disposed of.

Copy of this order may be transmitted to the trial court and SSP Shaheed Benazirabad for information.
