Mr. Shahid Ahmed Shaikh, Asstt. P.G. for the State along with SIP Bhoj Raj S.H.O. of P.S. Pothoro.

 

 

            On 10.06.2016 the learned District & Sessions Judge Umerkot was directed to depute any learned Judicial Magistrate to visit the place of alleged detention under the security cover of concerned Police Station and if the alleged detenues are found to be in unlawful detention they may be released forthwith.

            Learned Civil Judge Umerkot has submitted the report in which the names of alleged detenues are mentioned but it is clearly stated that they were not in wrongful confinement.

Today the S.H.O. of P.S. Pithoro has produced the alleged detenues. The report further states that the alleged detenues were moving freely at the land of respondent No.3 and no armed persons at the lands of respondent No.3 was found.

Mr. Nadeem Abbassi, Advocate has filed Vakalatnama on behalf of respondent No.3. The respondent No.3 is also present against whom the allegations have been leveled. Since the alleged detenues want to leave the place of respondent No.3, therefore, they are allowed to go according to their wish and will. The respondent No.3 is directed not to cause any harassment or intimidation to them and in case any harassment or threat is caused to the alleged detenues or the petitioner by the respondent No.3 then the respondents 1 and 2 shall take serious action against the respondent No.3 and F.I.R. will be lodged against him.

The petition is disposed of in the above terms.

Let a copy of this order be transmitted to respondents 1 and 2 for information and compliance.
