Learned A.A.G has filed the comments which are taken on record and copy has been supplied to the counsel for the petitioner.

The case of the petitioner is that his father Sahibdad was employee of Food Department as chowkidar. On 29.01.2009 he died during the service. After death of his father the petitioner moved an application on 03.03.2009 through proper channel to the respondent No.3 for his appointment on deceased employee quota. After filing the application the petitioner is continuously approaching the respondents but his case has not been considered. The application of the petitioner is available at Page 35 which was forwarded by District Food Controller Dadu to Deputy Director Food Hyderabad Region. The District Food Controller Dadu also forwarded the relevant documents of the petitioner applied on the son quota and in the letter the name of the petitioner is mentioned at serial No.3. In the comments filed by respondent No.3 the application of the petitioner was not disputed but it is stated that as soon as the application of petitioner is received to respondent No.4 he has forwarded the same to the concerned quarter for necessary action. Under Rule 11-A of the Sindh Civil Servants (Transfer and Promotion) Rules 1974 the provision of appointment on deceased son quota is available and after filing the application it was the responsibility of the concerned department to look into it and to pass necessary order on it.

Since there is no material dispute between the parties therefore, this petition is disposed of alongwith listed application with the directions to the respondents to consider the application of the petitioner in accordance with the law and pass necessary orders. If any document is not available which is required to be filed by the petitioner, the concerned department may call the petitioner and direct him to fill up the deficiency. This exercise shall be completed within three months.
