O R D E R
MOHAMMAD ALI MAZHAR---J.,In-fact the petitioners have approached this Court for implementation of order issued by Respondent No.2 on 05.08.2013 allowing pay fixation in higher scale with all fringe benefits. Copy of order is available at Page 41 of the Court file issued by the Export Processing Zones Authority (Administration Division) in pursuance of E.P.Z.A Board decision in its 105th meeting held on 03.07.2013 whereby the competent authority was pleased to allow time scale promotion (One time only) with immediate effect to the forty five (45) employees mentioned in the Office Order.
2. Learned counsel for the respondents No. 2 & 3 pointed out their comments in which it was admitted in paragraph-2 that on recommendation of the Board of Finance and Audit Committee the E.Z.P.A Board allowed time scale promotion to the staff in pursuance of decision taken in the 105th meeting and after examining the record, the committee recommended the actualization of time scale promotion vide order dated 05-08-2013. The learned counsel for the Petitioner argued that the office order dated 05.08.2013 was partially implemented and since its full implementation was not made therefore, the petitioners have approached this Court while the learned counsel though accepted the issuance of this order but he submits that if the order dated 05-08-2013 has not been completely implemented, E.Z.P.A Board will examine the same and if it is found that it has not been fully implemented the same shall be implemented within three months period. On this fair statement of
the learned counsel for the respondents No. 2 & 3 the learned counsel for the Petitioner is satisfied.
In view of the above, by consent this petition is disposed of with the directions to the Respondents No.2&3 to examine the service record of the Petitioners and if it is found that the above office order has not been implemented in its full force, then the management shall implement the same whithin three months as assured by the learned counsel for the Respondent No. 2 and 3.
