The alleged detenue Sh. Leelahan along with her minor daughter Reshman is present in person.

                        The respondent No.3 is also present in person.

            The petitioner is the real brother of Shrimati Leelahan who is alleged to have been in illegal confinement of her husband the respondent No.3.

            Shrimati Leelahan is present along with her minor daughter Reshman complains maltreatment and misbehavior of her husband Mehboob and states that she is wants to go with her brother rather than her husband.

            Since Shrimati Leelahan is sui juris and she is fully competent to decide where she wants to go, therefore, she is allowed to go with her brother. However, the respondent No.3 is at liberty to institute proceedings in the Family Court for restitution of conjugal rights, if any, as well as suit for guardian and wards for the custody and/or visitation right of his daughter Reshman.

            The petition stands disposed of in the above terms.
