            It is, inter-alia, contended that the applicant had filed a direct complaint under section 376, 377-B, 342, 506(2) and 34 PPC against the respondents 1 to 3  in the Court of learned District & Sessions Judge Dadu who transferred the case to the learned IInd Additional Sessions Judge Dadu, to decide the same in accordance with law.

 

The serious allegation has been leveled against the attitude and conduct of Presiding Officer that he is showing some sympathy to the accused persons and disgracing the complainant. This transfer application is pending since December 2014 but no comments have been filed so far by the learned Presiding Officer of IInd Additional Sessions Judge Dadu.

 

Today the learned counsel for the respondents 1 to 3 argued that without accepting or admitting the allegations mentioned in the transfer application and also for the reasons that the matter is lingering on and transfer application is pending since 2014, he has no objection if the case is transferred to any other Court at Dadu.

 

            Similarly the learned Assistant P.G. has also no objection and he submits that in order to avoid further delay in the matter, the transfer order may be passed so that the matter may be proceeded.

 

            In view of the above, this criminal transfer application is disposed of with the direction to learned District & Sessions Judge Dadu, either to proceed the Sessions Case No.497 of 2013 himself or assign the same to any other learned Additional Sessions Judge Dadu. It is expected that learned District & Sessions Judge Dadu will ensure that the case will be proceeded expeditiously and the trial is concluded preferably within a period of three (03) months.
