            A statement has been filed by learned counsel for the applicant stating therein that the applicant wants to withdraw this application and on instructions he will seek the appropriate remedy in the trial Court.

            The applicant claims that Mst. Najma is his wife and he has approached this Court for orders against the father of Mst. Najma so that she may be released from illegal confinement.

The alleged detenue Mst. Najma has sworn a counter affidavit which was duly verified by ISMS department of this Court wherein she has clearly stated that respondent No.4 is her real father and she is not in any illegal or wrongful confinement but she is residing with her parents on her own will.

After the affidavit sworn by Mst. Najma no case of any illegal detention or confinement is made out. However, the applicant has filed this statement for withdrawal of this criminal miscellaneous application but he is called absent. This criminal miscellaneous application is dismissed.
