Muhammad Ali Mazhar J.-  Despite some other reliefs claimed in these petitions the petitioners have also prayed for the directions against the respondents No.2 and 3 to allow the petitioners to sit in the viva voce/practical examination of paediatrics. Learned counsel for respondent No.1 has filed counter affidavit in both the petitions. Today counsel for the respondent No.2 and 3 has filed a statement on behalf of respondents No.2 and 3 with the letter of Controller of Examinations dated 25th May, 2016 addressed to the Registrar (Writ) of this Court. In this letter the number of both the petitions are mentioned and a decision of Vice Chancellor has been conveyed in the following words:-

 

“This is to inform you that the Vice Chancellor, University of Karachi has allowed the petitioners, as a last chance, to appear in viva voce/practical examinations to avoid any discrimination. This facility is given to petitioners subject to be proposed the date, announced by their respective college principals and this should not be quoted as precedent by any candidate in future.”

 

2.         After seeing this decision of the University communicated by the Controller the learned counsel for the respondent No.1 sought the directions through Principal of the respondent No.1 and he has no objection if this petition is disposed of in terms of above decision of Karachi University. However, he submits that this would be the last chance, the date of practical will be fixed by the Principal and the same will be communicated to the petitioner as well Karachi University in advance. The learned counsel for petitioners are satisfied and request that the petitions may be disposed of in the above terms. By consent both the petitions are disposed of accordingly. Office is directed to place copy of this order in the connected petition titled above. Pending applications are also disposed of.
