Muhammad Ali Mazhar J.- Learned counsel for the petitioner referred to page 163 which is a news clipping of Business Recorder to show that in order to resolve the grievance of the dock workers a committee has been constituted comprising five union members and four representatives of the Ministry and Port Qasim Authority. He argued that the first meeting of the committee was convened and agenda is available at page 163-A. The grievance of the petitioner is that they have 106 members but due representation was not given to the petitioner to give their point of view before the committee members. Learned counsel for the petitioner argued that the petitioner will be satisfied if this petition is disposed of with some directions to the Port Qasim Authority to provide right of audience to the General Secretary of the petitioner No.1 so that he may be able to express difficulties of their 106 members and safeguard their interest. When this matter was taken up in the first round, learned counsel for the Port Qasim Authority sought time to seek instructions from the department therefore on a joint request we kept aside this matter and in the second call the learned counsel for the KPT agreed that the committee constituted to deal with the issue of conversion of berths No.3 and 4, Port Mohammad Bin Qasim on BOT basis will provide ample opportunity of hearing to the General Secretary of petitioner No.1 and then act in accordance with law. The petitioner counsel is satisfied. By consent this petition is disposed of accordingly with pending applications.
