Muhammad Ali Mazhar J.- In both these petitions urgent applications have been moved by the counsel for the petitioners, but they relied upon the comments filed by respondent No.2 in both the petitions and argued that both the petitions can be disposed of in view of the comments filed by respondent No.2. Learned AAG present in Court has also gone through the comments filed by respondent No.2 and he has no objection if the matter is taken up for hearing of main case. Consequently, urgent application is allowed and the matter is taken up for hearing of main case.

 

2.         The case of the petitioners is that after complying with all codal formalities they were issued appointment letters on contract basis in the Directorate of Minorities Affairs Department, Government of Sindh. After considerable length of service they approached to the department for regularization of their services in terms of Sindh (Regularization of Adhoc and Contract Employees) Act, 2013. The respondent No.2 in both the petitions is the Secretary Ministry of Affairs Department, Government of Sindh who has filed the identical comments in both the petitions. To respond the plea of regularization taken by the petitioners it is clearly stated in reply of paragraph 7 that the case of petitioners’ regularization is under process. It is further stated that through Notification dated 16th September, 2014 issued by SGA&CD the scrutiny committee was appointed to examine the various cases of contractual employees. The scrutiny committee-III was given the task to examine the cases of contractual employees in BPS-16 to BPS-18. Subsequently, the members of the Scrutiny Committee were replaced. It is reiterated in the comments that after fulfilling codal formalities the department will place the names of employees working on contract basis before the Scrutiny committee-III. It is further stated that no discriminatory treatment is given to the petitioners but their case of regularization yet to be placed before the scrutiny committee-III constituted by the government for the purpose of regularization of contract employees under the Act. In response to para 9 of the petition again in the comments it is stated that the process for regularization of the petitioners under the said Act has been initiated and the cases will be forwarded to the Scrutiny Committee-III.

           

3.         Learned AAG after going through the comments filed by the respondent No.2 in both the petitions has no objection and he prays that both the petitions may be disposed of with some directions to the respondents. Learned counsel for the petitioners in both the petitions are satisfied.

 

4.         In view of the above the aforesaid petitions are disposed of with the directions to the respondent to expedite the regularization process and complete the same within three months.   Office is directed to place copy of this order in connected petition titled above.
