MUHAMMAD ALI MAZHAR-J: In fact the Petitioners have approached this Court for seeking directions against the Respondents to implement the Notification dated 30.03.2015 through which some amendments were made in Sindh Government Rules of Business, 1986.
Today, learned counsel for the Petitioners produced a copy of the Minutes of Meeting dated 09.02.2016, which shows that under the Chairmanship of the Chief Secretary, Sindh, a meeting was convened on 04.01.2016, which was attended by the Secretary, Education & Literacy Department, Secretary, Works & Services Department, Special Secretary, Finance Department, Additional Secretary, Works & Services Department, Additional Secretary, Education & Literacy Department, and Additional Secretary (Regulation), SGA&CD. In Paragraph-5 of the Minutes of Meeting the Issue No.4 was discussed and following decision was taken up in Paragraph-6:-
“6. The following decisions were also taken up by the Chief Secretary, Sindh.
i. No promotions would be done by Works & Services Department on the posts of Education Works Wing which are to be transferred to Education & Literacy Department.
ii. All posts of Education Works Wing reflected in the Budget Book 2015-16 be transferred to Education & Literacy Department. Finance Department would transfer the posts alongwith staff to the Education & Literacy Department.
iii. The posts of Electrical Division of Education Works Wing held up by Works & Services Department should be worked out immediately and transferred to Education & Literacy Department by 15th January 2016.
iv. Finance Department would transfer the share of M&R of Education Works Wing Buildings to Education & Literacy Department from Works & Services Department.”
When Sikandar Balouch, Section Officer, Works & Services Department, Government of Sindh, was confronted with the copy of the Minutes of Meeting, he has clearly stated that process has been started and in terms of decision mentioned in Paragraph-6 of the Minutes of Meeting, which certainly requires reasonable time to complete and he requests for two months’ time. Learned counsel for the Petitioner is satisfied with the statement.
In view of the above, this Petition is disposed of accordingly. A copy of this order may be transmitted to the Chief Secretary, Sindh and other participants of the meeting.
