Judgement 03-NOV-22 Yes It is observed that the mere heinousness of the charge and recovery of a huge quantity of the alleged contraband is no ground to convict the accused. The prosecution is under a bounden responsibility to drive home the charge by proving each limb of its case that essentially included the production of the witness tasked with the responsibility of keeping the narcotic in safe custody and safely transmitting the samples to the office of the Chemical Examiner. Failure to do so is fatal to the prosecution case. Hon'be Mr. Justice Muhammad Karim Khan Agha, Hon'ble Mr. Justice Zulfiqar Ali Sangi(Author)

Judgement 09-OCT-20 Yes Thus based on the discussion made hereinabove we are of the considered view that the prosecution has proved its case beyond a reasonable doubt against the appellant by producing reliable, trustworthy, and confidence-inspiring oral evidence as well as documentary evidence in support of the same. 36 Cr.Acctt.A 75/2018 (D.B.) Sindh High Court, Karachi 2018 MUMTAZ ALI NIZAMANI S/O LAL DINO NIZAMANI (Appellant) VS THE STATE (Respondent) D.B. Judgement 09-OCT-20 Yes As discussed above, we are of the firm view that the prosecution has proved its case beyond a reasonable doubt by producing trustworthy and confidence inspiring evidence against all three appellants and uphold their convictions. The appeals of the appellants Muhammad Asif Arshad and Muhammad Adil Arshad have not been pressed on merits and they only prayed for reduction of their sentence based on the mitigating circumstances mentioned above. We find such mitigating circumstances to justify a reduction in their sentences. We also consider that the sentences awarded to them were too harsh, therefore, the conviction awarded to them by the trial court is maintained, however, both their sentences are reduced to the time which they have already undergone which includes the additional sentence of imprisonment in default of fine but the fine imposed on them is still outstanding against them which shall be recovered by NAB in accordance with the law. The appellants Muhammad Asif Arshad and Muhammad Adil Arshad are in custody, they are ordered to be released forthwith if not required in any other custody case. Judgement 22-NOV-22 Yes No direct enmity or ill will has been suggested by the appellants against the complainant or any of the officials who participated in recovery proceedings during cross examination and therefore in the circumstances the police officials were good witnesses and could be relied upon if their testimony remained un-shattered during their cross-examination. Judgement 05-SEP-22 Yes The Police officials are as good as private witnesses and their testimony could not be discarded merely for the reason that they were police officials unless the defence would succeed in giving dent to the statements of prosecution witnesses and prove their mala fide or ill-will against accused which the defence counsel have neither been able to do or show during crossexamination. Judgement 16-SEP-22 Yes The motive is always a double-edged weapon. No doubt, the previous enmity can be a reason for the appellant to commit the alleged crime, but it can equally be a reason for the complainant side to falsely implicate the appellant in the case of a previous grudge. Hon'be Mr. Justice Muhammad Karim Khan Agha(Author), Hon'ble Mr. Justice Zulfiqar Ali Sangi(Author)

Judgement 15-SEP-22 Yes It is observed that mere heinousness of the charge and recovery of huge quantity of the alleged contraband is no ground to convict accused. The prosecution is under a bounden responsibility to drive home the charge by proving each limb of its case that essentially included production of the witness, tasked with the responsibility of transmitting the samples to the office of Chemical Examiner. Even otherwise, the provision of Section 25 of the CNS Act has provided the exclusion of Section 103 Cr.P.C. during recovery proceedings. Judgement 01-SEP-20 Yes Since the appellant is the sole breadwinner of a large family, old age of above 60 years and no loss has occurred to the Government therefore in our view is capable of reformation under such circumstances, we hereby dismiss the instant appeal of the appellant on merits but since we find the sentence rather harsh keeping in view the submissions of the appellant , we hereby reduce/alter the sentences of the appellant and convict him under section 9(a) (vi) of the National Accountability Ordinance, 1999 and sentence him to suffer R.I. for five (05) years and to pay fine of Rs.500,000/- (five lac). The appellant shall forthwith cease to hold public office, if any, held by him and he stands disqualified for a period of ten (10) years to be reckoned from the date of elected, chosen, appointed or nominated as a member or representative of any public body or any statutory or local authority or in service of Pakistan or of any province so also he shall not be allowed to apply for or be granted or allowed any financial facilities in the form of any loan or advances from any bank or Financial Institution in the public sector, for a period of ten (10) years from the date of conviction. Under these circumstances the interim pre-arrest bail granted to all the petitioners earlier by this court is recalled with immediate effect.
