Order 30-SEP-20 Yes In the captioned Petition bearing No.D-1970 of 2019, the only issue involved is the issuance of two Corrigendum dated 11.03.2019 & 16.6.2019 respectively relating to advertisement . The Petitioner has assailed the legality of the above-specified Corrigendum whereby Respondent-Board changed the academic qualification of candidates as well as the upper age limit from 62 to 65 years for the post of Vice-Chancellor of Peoples University . We in the aforesaid circumstances hold that the recommendation of the Search Committee to the competent authority for the appointment of Vice-Chancellor PUMHSW, Shaheed Benazirabad in pursuance of corrigendum as discussed supra was without lawful authority and awarding marks to the candidates by the Search Committee is also held to be against the clear command of the Honorable Supreme Court in the cases discussed in the preceding paragraph. Accordingly, we direct the Search Committee /competent authority to hold a fresh interview of the shortlisted candidates made before the issuance of corrigendum and make recommendation to the competent authority for the appointment of Vice-Chancellor, PUMHSW, petitions are disposed of. 12 H.C.A 29/2006 (D.B.) Sindh High Court, Karachi 2006 Muhammad Imran Mustaqeem & Ors (Appellant) VS Muhammad Mustaqeem & Ors (Respondent) D.B. Judgement 27-FEB-24 Yes The object of petition for Letters of Administration is only to the extent of its grant or otherwise and the question of sale and purchase of the properties does not arise whereas in the instant matter despite objections taken by one of the legal heirs for its conversion into a suit, the property was attempted to be auctioned. Once the property devolved amongst the legal heirs that was and is the end of the lis filed in shape of petition for Letters of Administration. Hence, in all fairness not only the impugned order is set aside and appeal is allowed but now since the property is to be devolved amongst the legal heirs, the Letters of Administration be issued accordingly, if it has not been issued as yet, leaving it up to them i.e. legal heirs to see/decide the fate of their property as they deem fit and proper and not in a petition, which is/was only to the extent of grant of Letters of Administration. Order 26-JAN-24 Yes It was eventually be decided by the learned single Judge on the strength of the evidence likely to be recorded by the parties, however, prima facie it seems that the amount was paid from the account of deceased Azad Bin Haider and at this point of time respondent No.1 (son of deceased), cannot get away with the entire rental income of the aforesaid property depriving the daughters of deceased. In all fairness, he could only claim his share out of the rental income from the said property from the Nazir, whereas, rest of the amount shall remain with the Nazir duly invested in a profit bearing scheme, until and unless it is resolved by the court. Order accordingly. Hon'ble Chief Justice Mr. Justice Muhammad Shafi Siddiqui(Author), Hon'ble Mr. Justice Omar Sial

67 Const. P. 4387/2014 (D.B.) Sindh High Court, Karachi 2014 Pakistan Tibbi Pharmaceuticals Manufacturers (Petitioner) VS Fed. of Pakistan and Ors (Respondent) D.B. Judgement 26-FEB-18 Yes The petitions arise under and in relation to the Drug Regulatory Authority of Pakistan Act, 2012 (DRAP Act). petitioners contend, the DRAP Act cannot, does not and should not apply to various products as manufactured, sold, used or imported by them, including Unani medicines, prescriptions and preparations, We start with the first set of questions, which relate to the constitutionality of the DRAP Act as enacted under Article 144. This Article originally had two clauses, of which the second was omitted by the 8th Amendment in 1985. two changes made by the 18th Amendment, one was necessitated by the omission of the Concurrent List, and need not detain us. The other, which will require some comment, was that originally Article 144 applied only if two or more Provincial Assemblies passed the necessary resolutions. The present Constitution of course had two Legislative Lists on its commencement. The competences listed in the Federal List were exclusive to the Federation, those on the Concurrent List were common, and those which were not enumerated were exclusive to the Provinces. VThat ability of course is one of the defining characteristics of federal legislative power, since in respect of matters that lie in the Federal domain by right Parliament can make laws for the whole of Pakistan or any part thereof. It would be unduly restrictive of the purpose and intent behind Article 144 if Parliament, while making the law for which it has been given power cannot include therein provisions that relate to matters in the Federal domain as of right. Secondly, a provincial law made subsequent to the law made by the Federation under Article 144 may override or impliedly repeal the latter. This follows directly from the express provision that the Provincial Assemblies may amend or repeal the law made by Parliament. The 1976 Act, in like manner, fractured and receded. It became provincial legislation and hence territorially bound. It now so operates in this and all other Provinces. It must be kept in mind that this position has remained unaltered, and is unaffected by the enactment of the DRAP Act under Article 144. Whatever may be the relationship of, and interaction between, the two laws, the 1976 Act does not now transcend or cross provincial boundaries in the manner of the DRAP Act. It is therefore our conclusion that in the present case, the scope of the legislative competence entrusted to Parliament in terms of Article 144 is governed by the terms of the resolution passed by the Punjab Assembly. Within 30 days of announcement of judgment the Authority under the DRAP Act shall issue proper guidelines, Simultaneously with posting the guidelines on its website, the Authority shall issue notice to each petitioner in the petitions to which this para applies. Interim orders made in any petition to which this para applies shall continue but will lapse 30 days from the date on which the guidelines are posted as above or the date on which the determination is made, whichever is later. following petitions are dismissed: CP D-4387/2014 and CP D-1684/2017. e following petitions are disposed off in terms of para 50 herein above: CP Nos. 100 2022 PLD Sindh 47 Civil Ref. 2/2018 (F.B.) Sindh High Court, Karachi 2018 Assistant Chief Inspector of Stamps (Appellant) VS .. (Respondent) F.B. Judgement 16-NOV-21 Yes The Court had itself observed that the valuation done by the family Court was for a particular purpose and since it was not a decree of a Court the valuation so carried out was not binding. And then the Court went on to observe that even if there is a decree of the Court, the stamp duty would be payable as per Valuation Table. Though on facts the said judgment is not relevant; nonetheless, since it has been cited before this Full Bench, therefore, we are compelled to hold that we do not approve such observations made by the Division Bench in the aforesaid paragraph. Had it been in performance of decree, an instrument is being registered, it ought to be on the basis of value determined in the decree and/or agreement entered into for which performance is to be made in terms of Court decree. In such situation there was no occasion for altering/undervaluing the property to avoid stamp duty as the value is already determined by Court of law or decree. It is only in case when the property has changed its status lawfully i.e. from a built-up property to an open plot or from a semi-constructed property to a fully constructed property, the value of the property may be altered in instrument sought to be registered. Thus, when the property sold out on the basis of a decree, which decree has valued the property in question, then the right of valuing the property does not rest with the vendor and vendee and/or the concerned authority. Judgement 30-JAN-24 Yes It seems that while the claim of the bank is being multiplied continuously with the passage of time, whereas, the value of the property as determined in the year 2016 was fixed to be set off against current exaggerated claim of Bank. This is no justification. No one should suffer on account of court???s error whether it is a borrower or the bank. If at all the claim is to be set off, it should be set off in terms of the present market value and not on the basis of value of 2016 against claim of bank, as exist now. Six years have been passed and the properties must have been multiplied manifolds, which was not accounted. 127 2024 CLD 744 I. A 120/2016 (D.B.) Sindh High Court, Karachi 2016 Faysal Bank Limited (Appellant) VS Masood Asghar & another (Respondent) D.B. Order 30-JAN-24 Yes Financial Institutions (Recovery of Finances) Ordinance, 2001 (???FIO 2001???) is a special law and covers all proceedings upto execution. In the previous law that is Act of 1997, it enabled the Court to convert the proceedings into execution application on preferring an application whereas the frame of instant law is different as can be seen in terms of Section 19 of the FIO 2001. It provides that upon announcement of Judgment and decree the suit shall automatically convert into execution application. Thus no sooner the Judgment and Decree is passed the proceedings stand converted into execution application and the act does not provide a way to file a fresh execution application, as inadvertently did by the appellant. At the most, since an appeal was pending before this Court and the machinery of execution was not triggered, the application that was inadvertently moved as an execution application could at the most be considered for triggering machinery of the Banking Court where the suit was decreed and converted into execution application. Judgement 29-MAR-24 Yes The appellant has already challenged the order of respondent No.3 before a forum he has elected hence to circumvent the findings of respondent No.3, being a judicial forum as invoked by the appellant, the jurisdiction of this Court on the original side cannot be invoked for an injunction. The order of the respondent No.3 in the follow up of its jurisdiction could well be agitated before a proper forum, though apparently the appellant in his own wisdom has challenged it separately by filing a writ petition No.1850 of 2022. Order 18-APR-24 Yes We have enquired as to what was the jurisdictional defect or constitutional error that compelled them to file these petitions under Article-199, learned counsel repeated that in fact the service was not effected. This could hardly be a reason for us to intervene, as this is not the fact-finding court. Unless the jurisdictional defect or a constitutional violation is pointed out, this Court cannot probe further. Hon'ble Chief Justice Mr. Justice Muhammad Shafi Siddiqui(Author), Hon'ble Mr. Justice Omar Sial C.P.L.A.597-K/2024 M/s Shahzad Estate Pvt. Ltd. v. Nelofar Nasreen and others Before Supreme Court of Pakistan Pending
131 I. A 59/2020 (D.B.) Sindh High Court, Karachi 2020 Arshad Mirza (Appellant) VS Darsyus T. Sethna & another (Respondent) D.B. Order 25-JAN-24 Yes There is no cavil to this proposition that under special summary chapter, only special jurisdiction is conferred upon the court, proceeding whereunder could only be seen under negotiable instruments and any deviation thereof would give rise to an exercise of jurisdiction not vested upon the court and the order/judgment is only a nullity. In the instant matter, a decree is passed under summary chapter against an individual who has not executed any negotiable instrument and hence could not have been subjected to summary proceedings. Certainly, if the presence of appellant/defendant No.2 was necessary and important in the wisdom of plaintiff/respondent No.1, in the sense that he was a guarantor or that amount could be recovered from him, then the case could have been proceeded against them/him under ordinary civil jurisdiction. When confronted, Mr. Fazal ur Rehman that this decree could not have been passed under summary chapter against him and/or could not be executed against the appellant, learned counsel for the respondents though initially insisted that it was a belated attempt on the part of the appellant to raise this point, but later conceded as no limitation would run against an order which is a nullity or without jurisdiction in the eyes of law. 132 H.C.A 117/2023 (D.B.) Sindh High Court, Karachi 2023 Uzair Saboor (Appellant) VS Federation of Pakistan & Others (Respondent) D.B. Judgement 29-APR-24 Yes To regulate the products described in the DRAP Act, 2012, the respondent No.2 only wants that they may be enlisted with it so that they may regulate it as being an alternative medicine/therapeutic goods. While appellants would make an application for enlistment, it would certainly be without prejudice to above understanding and notwithstanding their stance, a proper scrutiny would still be undertaken by DRAP to adjudge it as a product/drug etc, to be enlisted within frame of law (act and rules), which order will then be conclusive, subject to a challenge within DRAP Act, 2012. Judgement 17-JAN-24 Yes The judgment may not bind us in terms of Article 189 of the Constitution of the Islamic Republic of Pakistan, 1973, but we are in agreement with the observations made therein that in the first instance it is to be seen whether a plaint has complied all the requirement of Section 9 of the FIO, failing whereof, the consequences would follow, which in the instant case should have been a grant of leave in the absence of a true Statement of Accounts, as it is not the correct reflection of account. Judgement 15-MAR-24 Yes The issuance of warrants in respect of decrees, which were allegedly unaccomplished, is not a routine matter. The case of Abdul Basit Zahid1 and the case of Precision Engineering Ltd.2 speaks volume. In the first case the Division Bench was of the view that Section-51 CPC provides for execution of a decree through arrest and detention of the judgment-debtor and the proviso thereof furnishes certain safeguards against the deprivation of liberty and contemplates that such power can only be exercised under certain given situations. In the instant case, such situations were not considered prior to the issuance of warrants. Hon'ble Chief Justice Mr. Justice Muhammad Shafi Siddiqui(Author), Hon'ble Mr. Justice Omar Sial

Judgement 12-SEP-24 Yes *There is no cavil that the point of jurisdiction of this Court is to be addressed first and at no point in time the merits of case should be discussed however the arguments of the petitioner???s counsel are of such nature which compelled us to go into brief history of the case, which should, in any case, may not be counted as exercise of jurisdiction under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973. **Now since our jurisdiction is contoured in terms of vely couched Article 225, having essence of mandatory application, read with numerous judgments of Supreme Court providing a limited scope to thrive, we could also draw an inference that both acceptance and denial to a recount of votes on any ground could fetch and attract the jurisdiction of the Tribunal followed by orders of Returning Officer/ Commission Hon'ble Chief Justice Mr. Justice Muhammad Shafi Siddiqui(Author), Hon'ble Mr. Justice Omar Sial

Judgement 21-FEB-24 Yes As to the objection that decretal amount has to be deposited before this Court as without it appeal could not be heard and decided, we are of the view that Order XXI Rule 23-A PC, as relied upon by the learned counsel for respondent, does not demonstrate an embargo on powers being exercised by the appellate Court while hearing appeal; it only demonstrates that the executing Court hearing objections, filed by judgment debtor to the grant of execution, shall not proceed unless the decretal amount is secured. We are not executing Court who is hearing the objections of judgment debtor, rather an appellate authority Hon'ble Chief Justice Mr. Justice Muhammad Shafi Siddiqui(Author), Hon'ble Mr. Justice Omar Sial

Judgement 16-APR-24 Yes The only ground which impressed the learned Banking Court was that apparently the registered instruments (subleases) were fictitious and forged. These are only words against words; it is only in response to 12(2) application that the banking Court found that the instruments are not genuine and fake. In all fairness this requires trial, more particularly when the registered instruments were obtained and/or executed much before equitable and registered mortgage of 2003; whereas the subleases of the appellants were apparently registered in the year 1998.
